Terms & Conditions of Service

Last Updated: September 2026

1. Scope of Service and Intermediation Mandate

EUROPETCG operates as an online peer-to-peer and business-to-consumer marketplace facilitating connections between registered buyers and sellers of collectible trading cards (TCG) and related items. EUROPETCG is neither the manufacturer, legal owner, nor direct seller of the items listed by independent users.

The platform acts strictly as a technological intermediary under a collection mandate (payments on behalf of third parties). EUROPETCG holds buyer funds in secure escrow on behalf of the seller until transaction completion. The platform solely invoices for its intermediation fee (between 2.5% and 5.0% depending on delivery method and account tier, as published in the Fees Schedule).

2. User Accounts and Verification

To transact on the platform, users must register with truthful, complete, and accurate information. The creation of multiple fraudulent accounts, identity theft, or artificial price manipulation is strictly prohibited and leads to immediate suspension.

3. Seller Balances and Payouts

Once escrow funds are released upon successful order delivery, sellers can withdraw their available balance via authorized regional payment rails (Stripe Connect, Wise, or PayPal) in accordance with geographical availability.

  • PayPal: Active international payout method for all sellers. Payouts are transferred directly to the seller’s verified PayPal email address within 24-48 business hours with a 2.0% technical payment processing fee.
  • Catalogue Reinvestment: Sellers may use 100% of their available balance to purchase any cards or sealed products in EuropeTCG with 0.0% fee.
  • Wise & Local Bank Accounts: Currently in technical onboarding and corporate compliance review (coming soon).
  • Stripe Connect: Automated direct SEPA bank payouts in supported European Union / EEA regions.

External payment gateway fees or foreign currency conversion expenses imposed by third-party processors are borne by the seller upon initiating withdrawal.

Reference Currency & Banking Surcharges: The official reference currency on EuropeTCG is the Euro (EUR / €). EuropeTCG does not determine or control exchange rates, currency conversion spreads, or international transaction fees applied by the user’s local issuing bank or payment gateway. All foreign exchange fees or domestic banking surcharges are strictly borne by the user.

Minimum Payout Threshold: The minimum amount required to request a payout is 25,00 €. Withdrawal requests below this threshold cannot be processed due to payment processing optimization and third-party fee efficiency.

4. Guarantee Escrow Mechanism, Binding Arbitration & Untracked Shipping Rules

To protect all transacting parties, buyer funds are held in secure escrow by EuropeTCG and will not be disbursed to the seller until delivery is verified or confirmed by the buyer.

Contractual Submission to Binding Arbitration

By utilizing EuropeTCG, both Buyer and Seller irrevocably submit all shipping discrepancies, order cancellations, and non-delivery disputes to EuropeTCG as their exclusive escrow arbiter. Both parties contractually agree that EuropeTCG’s determinations regarding the refund, release, or distribution of held funds are final, conclusive, and legally binding, waiving any court claims against EuropeTCG for its escrow decisions.

Loss and Untracked Shipping Policy (PWE / Ordinary Mail):

  • Certified Tracked Shipments: If postal carrier loss is formally verified with tracking proof, shipping insurance and carrier claims are applied.
  • Untracked Ordinary Shipments (Sin seguimiento / Carta ordinaria): In untracked postal shipments, dispatch proof rests with the seller:
    • Without Official Post Office Receipt (100% Buyer Refund): If the order is not delivered and the Seller fails to upload a clear photograph of the official post office receipt or stamped dispatch voucher into the dispute, dispatch is not legally verified. EuropeTCG will refund 100% of the funds to the Buyer. The Seller explicitly waives all claims, lawsuits, or actions against EuropeTCG for said refund.
    • With Verified Post Office Receipt (50/50 Shared Risk Rule): If the package fails to arrive after 30 calendar days and the Seller uploads verifiable photographic proof of the official post office postage receipt, the 50/50 Shared Risk Rule applies. Held funds are split equally: 50% refunded to the Buyer and 50% released to the Seller. Both parties contractually waive any right to claim the remaining 50% from EuropeTCG or initiate legal claims against the platform for this shared loss.

5. Shipments, Customs within the EU and Extra-EU Imports (Incoterms DAP)

Intra-European Union shipments between EU Member States benefit from the free circulation of goods and are 100% exempt from customs duties, tariffs, and border inspections. For transactions originating from or delivered to countries outside the European Union (such as the United Kingdom, Switzerland, the United States, or Japan), shipments are performed under international DAP (Delivered at Place) terms. The Buyer is solely responsible for any local import VAT, tariffs, or customs clearance formalities required by the receiving country.

Customs Refusal Policy: Refusal by the Buyer to pay customs duties or complete customs clearance, or the subsequent abandonment or confiscation of the package by extra-EU customs authorities, DOES NOT entitle the Buyer to any refund from escrow. The Buyer shall remain liable for all return transit or storage costs incurred.

6. Prohibition of Fraudulent Chargebacks and Right of Set-Off

Users agree to resolve all transaction disputes exclusively through EuropeTCG’s internal dispute resolution and escrow arbitration mechanisms. Initiating unauthorized payment chargebacks, payment reversal requests, or bank disputes through credit card issuers or payment gateways (Stripe, PayPal) circumventing EuropeTCG’s determinations constitutes a severe, bad-faith breach of contract.

If an unauthorized chargeback or reversal is initiated after funds have been disbursed to the seller, EuropeTCG reserves the right to immediately suspend the offending account, exercise the right of set-off against any present or future user balances, and recover the disputed funds along with associated banking dispute administrative fees (15,00 € per occurrence) through all available legal means.

7. Individual User Tax Responsibility and DAC7 Compliance

EuropeTCG acts strictly as an intermediary information society technology platform. Each user (both buyer and seller) is exclusively responsible for complying with all tax declarations, registrations, and payment obligations applicable to their sales and purchases under the laws of their European country of tax residence.

In compliance with European Union regulations (Directive (EU) 2021/514 - DAC7) and Spanish Law, EuropeTCG automatically reports annual transaction activity to the Spanish Tax Agency (AEAT) for sellers who reach or exceed 30 transactions or 2.000,00 € in gross sales within a calendar year.

8. Independent Logistics Carriers, Force Majeure and Delays

EuropeTCG does not operate physical transport or shipping services. Logistics carriers (including Correos, Deutsche Post, DHL, Mondial Relay, DPD, GLS, UPS, SEUR, CTT, Poste Italiane, Colissimo, etc.) are independent third-party contractors. EuropeTCG assumes no liability for transit delays, parcel holds, or lost items resulting from events of force majeure, including labor strikes, transport blockades, extreme weather events, or postal authority disruptions.

9. Limitation of Liability, Indemnity and Class Action Waiver

EUROPETCG provides its platform on an "as is" and "as available" basis without express or implied warranties. In no event shall EuropeTCG or its operators be liable for indirect, punitive, or consequential damages resulting from third-party actions, postal carrier loss, or seller grading inaccuracies.

Liability Cap: The maximum aggregate liability of EuropeTCG to any user for any claim arising out of or related to a transaction shall be strictly capped at the commission fee actually earned by EuropeTCG on that specific transaction.

Class Action Waiver: Users agree that any claim or arbitration will be conducted solely on an individual basis, waiving any right to initiate, join, or participate in class actions or collective proceedings against EuropeTCG.

10. Artificial Intelligence (AI) Technology Disclosure (FTC & EU AI Act)

In compliance with the U.S. Federal Trade Commission (FTC) guidelines, the European Union Artificial Intelligence Act (EU AI Act), and international consumer transparency standards, users are informed that EuropeTCG’s platform software, search and recommendation algorithms, catalog matching tools, and the "Shopping Wizard" optimizer have been developed and maintained partially with the assistance of generative artificial intelligence and automated programming models.

All automated features are provided "as is". All dispute resolutions, account actions, and financial payouts remain subject to direct human oversight and evaluation.

11. Prohibition of Counterfeit Products & Notice and Takedown

The listing, sale, or distribution of counterfeit cards, unauthorized proxies, or intellectual property infringements is strictly forbidden. Any user offering counterfeit goods will face immediate account termination and forfeiture of pending balances for buyer restitution. Infringement notices may be submitted in accordance with our Digital Services Act (DSA) notice procedure.

12. Applicable Law and Legal Contact

These conditions are governed by the applicable laws of Spain and the European Union. For any legal inquiries, dispute consultations, or formal notices, please contact us at: [email protected]
